1. Acceptance of These Terms
These Terms of Service ("Terms") govern your access to and use of https://nody.chat and related services (the "Service") operated by Nody. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2. The Service
Nody is a canvas-based workspace for exploring ideas with multiple AI models. We may add, change, or remove features at any time, and parts of the Service may be offered in beta or preview form without guarantees of availability or stability.
3. Accounts
You sign in with your Google account. You are responsible for activity under your account, for keeping access to your Google account secure, and for the accuracy of information you provide. You must be old enough to form a binding contract in your jurisdiction to use the Service.
4. Acceptable Use
You agree not to:
- use the Service for unlawful purposes or to create or distribute illegal content;
- attempt to disrupt, reverse engineer, overload, or gain unauthorized access to the Service or other users' data;
- resell or redistribute the Service without our written permission;
- upload content you do not have the right to share, or that infringes others' rights;
- use automated means to abuse free quotas, points, or trial access.
We may suspend or terminate accounts that violate these rules.
5. AI-Generated Content
Responses are generated by third-party AI models and may be inaccurate, incomplete, or offensive. AI output is not professional advice (including legal, medical, or financial advice). You are responsible for reviewing and for how you use any output. Your use of third-party model providers may also be subject to their terms.
6. Your Content and Intellectual Property
You retain ownership of the content you create or upload (such as canvases, prompts, and documents). You grant us a limited license to store, process, and transmit that content as needed to operate the Service, including sending prompts and relevant context to model providers to generate responses.
The Service itself — including its software, design, and branding — is owned by us or our licensors and is protected by applicable laws.
7. Fees and Billing
Paid plans, credits, and point packages are processed by Stripe. Prices and included allowances are shown in the Service and may change with notice. Except where required by law, fees are non-refundable. You are responsible for any taxes associated with your purchases.
8. Third-Party Services
The Service relies on third parties such as Google (sign-in), Stripe (payments), and AI model providers. We are not responsible for third-party services, and their terms and privacy policies apply to your use of them.
9. Disclaimer of Warranties
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI output will be accurate.
10. Limitation of Liability
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or USD 50.
11. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination (such as intellectual property, disclaimers, and liability limits) will survive.
12. Changes to These Terms
We may update these Terms from time to time. We will post the updated version on this page and update the date above. Continued use of the Service after changes take effect means you accept the updated Terms.
13. Governing Law
These Terms are governed by the laws of the jurisdiction in which the operator of Nody is established, without regard to conflict-of-law rules. Disputes will be resolved in the courts of that jurisdiction, unless mandatory local law provides otherwise.
